Trademark opposition
A published trademark application invites opposition within the prescribed window, from the side opposing and from the side defending. Rapidfiling manages both directions: the notice of opposition, the counter-statement, and the evidence stages.

Service overview
When a trademark application is advertised in the Trade Marks Journal, any person who believes it would damage their rights can oppose it within the prescribed period from publication. The opposition proceeds in defined stages: notice of opposition, the applicant's counter-statement, evidence rounds on both sides, and finally a decision by the Registrar, sometimes after a hearing. Miss a stage's deadline and the law decides against the defaulting side, timers govern this proceeding more than anything else.
The work is evidentiary. An opposition succeeds or fails on use evidence, first-use dates, sales and advertising records, and the similarity analysis between the marks and the goods. Defending means proving your own use and answering the opponent's grounds; opposing means proving yours and disproving theirs. Thin files lose to organised ones.
Rapidfiling assesses the case first and says what the evidence supports, drafts and files each stage within its deadline, and coordinates qualified advocates where the matter calls for representation.

How the process works
1. Enquire with the notice or publication
Share the journal entry or opposition notice through the form on this page, with its dates.
2. Case assessment
We assess the grounds and evidence and state the realistic prospects before anything is filed.
3. Stage filings
The opposition or counter-statement is drafted and filed within deadline, followed by the evidence rounds.
4. Decision and hearing
Where a hearing is scheduled, qualified advocates are coordinated; the decision and next steps are reported in writing.
Fees and timing
What influences the quote
- Which side of the proceeding you are on and how many grounds are pleaded
- Volume of evidence to be prepared and sworn
- Whether hearings follow the written stages
Government fees and professional fees are shown separately in every quote. GST treatment is confirmed in the quote. Rapidfiling does not publish fixed prices for this service; request a quote to receive the fee breakdown for your case.

Important limitations

- Court enforcement of rights is separate and needs counsel assessment
Frequently asked questions
How long does an opposition window last?
The window from journal advertisement is prescribed under the Act and Rules, four months, extendable by a further month on request. We verify the exact dates from your publication and act within them.
Can an opposition be settled between the parties?
Yes, oppositions are commonly withdrawn on agreed terms, such as coexistence conditions. Settlement drafting still needs care so the Registry records it correctly; we handle the withdrawal filings.
What evidence carries the most weight?
Contemporaneous proof of use: dated invoices, advertising, registration certificates, and sales records around the relevant dates. Recollected stories without documents rarely move the needle. We tell you what to assemble.
What happens after the evidence rounds?
The Registrar decides on the record, sometimes after a hearing. The mark proceeds to registration if the opposition fails, or is refused if it succeeds, with appeal routes available in both directions.
