Design objection response

A design application that draws objections in examination moves forward only through a written reply filed within the window. Rapidfiling reads the objection, assesses it honestly, and files the response that the file supports.

Service overview

The Designs Office examines applications and raises objections where the design appears not new, lacking eye-appeal, or where the representations are defective, unclear views, inconsistent scales, or features shown that should not be claimed. The response window is prescribed, and a missed deadline pushes the application toward refusal or lapse.

Replies split by objection type. Representation defects are fixed by corrected drawings and views, often the easiest path to acceptance. Substantive objections on novelty need argument: distinguishing the cited prior designs feature by feature, or amending the claimed features where the office's reading is right. Arguments made on the wrong premise waste the window; the assessment comes first.

Rapidfiling reviews the objection and the file, states which objections can be answered and how, drafts the reply with corrected representations where needed, and files within the window.

Fees and timing

What influences the quote

  • Number and type of objections in the report
  • Whether corrected representations must be redrawn
  • Time remaining before the window closes

Government fees and professional fees are shown separately in every quote. GST treatment is confirmed in the quote. Rapidfiling does not publish fixed prices for this service; request a quote to receive the fee breakdown for your case.

Important limitations

  • The office may maintain objections and proceed to refusal or a hearing
  • Amendments cannot add new matter beyond what was originally disclosed
  • Substantive novelty objections sometimes cannot be overcome, we say so before drafting

Frequently asked questions

What is the deadline to respond?

The Designs Rules prescribe the response window from the examination report, six months in the standard route. We confirm your exact date from the report and file well inside it.

What are the most common objections?

Lack of novelty against prior designs, absence of eye-appeal, and defective representations. The last is the most fixable, corrected drawings often clear the file.

Can we amend the design in the reply?

You can correct representations to match what was originally disclosed, but you cannot introduce a new design. We advise which amendments the rules permit for your file.

What happens if the reply fails?

The office may refuse the application or list a hearing. Refusal closes the application; we assess whether any further step exists honestly rather than filing for filing's sake.
