Trademark objection response
An examination report with objections pauses your trademark application until a written response is filed within the prescribed window. Rapidfiling drafts the reply to the objection and files it on time.

Service overview
When the Trade Marks Registry examines an application and finds issues, it issues an examination report stating the objections, commonly similarity to an earlier mark, lack of distinctiveness, or defects in the specification of goods and services. The response window is short in law, and an unanswered report leads the application toward abandonment.
A response is an argument in writing. It addresses each objection with reasons and evidence: distinctiveness arguments built on the mark's character, search-based comparisons showing the cited marks are not conflicts, amended specifications where the examiner's issue is scope. Reply quality varies more than filing quality does, a generic response earns a hearing or a refusal, while a reasoned one with the right evidence often clears the objection at the written stage.
Rapidfiling reads the examination report, tells you honestly which objections are strong and which are weak, drafts the reply, and files within the window with a receipt you can verify on the registry portal.
Who this service is for
- Applicants who received an examination report with objections
- Applications whose response window is close and need a reply filed properly
- Owners whose earlier self-filed applications were objected to
- Applicants wanting a second opinion before a hearing follows the reply
Scope of support
What support includes
- Reading of the examination report and a written assessment of each objection
- Drafting of the reply with legal grounds and evidence for the arguments made
- Amendments to the specification or mark, where the objection calls for them
- Filing of the response within the window and confirmation with the receipt
What support does not include
- Hearing representation, quoted separately if the Registry schedules one
- Any promise the objection will be waived, the Registry decides after reading the reply
- Applications already in show-cause or abandoned status, which follow a different path
Requirements and documents
- The examination report, or the application number so we can pull it
- Proof of use (invoices, packaging, sales figures, or advertising) where distinctiveness is argued
- The original application details and the applicant's instructions on scope
How the process works
1. Enquire with the application number
Share the examination report or application number through the form on this page.
2. Objection assessment
We read the report and give you a written view of each objection's strength before drafting.
3. Reply drafting
The response is drafted addressing each objection with grounds and evidence, and reviewed with you.
4. Filing within the window
The reply is filed on the registry portal before the deadline and the filing receipt is shared.
Fees and timing
What influences the quote
- Number and type of objections in the report
- Whether evidence of use needs compiling
- Time left before the response window closes
Government fees and professional fees are shown separately in every quote. GST treatment is confirmed in the quote. Rapidfiling does not publish fixed prices for this service; request a quote to receive the fee breakdown for your case.

Important limitations
- The Registry may still maintain the objection and schedule a hearing or refuse the mark
- Missed windows lead to abandonment, which requires restoration steps that are not always available
- Arguments about very similar marks can fail despite a well-drafted reply
Frequently asked questions
What is the deadline to respond to an examination report?
The window is prescribed under the Trade Marks Rules, thirty days from receiving the report, extendable by a month with the prescribed fee on request. We confirm your exact date from the report and file well inside it.
What happens if no reply is filed?
The application is abandoned under the Act's provisions. If that has already happened, tell us, the restoration route exists but is narrow, and we will assess it honestly.
Can objections be removed by amending the application?
Yes, sometimes. Specification amendments or mark disclaimers resolve certain objections. We propose amendments where they help and argue grounds where the mark stands as filed.
Will we get a hearing after the reply?
Depends on the Registry's assessment of the reply. Strong written replies often clear without a hearing; contested ones move to show-cause hearings, which we quote separately with the hearing notice in hand.
