Service overview
Patents in India are granted under the Patents Act, 1970 for inventions that are new, involve an inventive step, and are capable of industrial application. The application's heart is the specification (the document that describes the invention and defines the claims) and its drafting is technical work done by qualified patent professionals. Rapidfiling's role is the structure around that drafting: the disclosure process, the filing mechanics, and the sequence of forms and fees.
Two filing shapes exist. A provisional application secures an early priority date with a description of the invention, buying up to twelve months for the complete specification, the standard route when the invention is still being finalised or funding is being arranged. Filing directly with the complete specification suits inventions ready to claim. Both start the same clock; the choice shapes the budget and the urgency of the drafting work.
After filing, the application is published at eighteen months, examination follows on request or on the Office's schedule, and the prosecution runs through responses until grant or refusal. Rapidfiling manages the calendar and keeps the paperwork right while the professionals handle the substance.

The specification is prepared with qualified patent professionals, reviewed with you, and filed with the forms and fees.
4. Prosecution calendar
Publication, the examination request deadline, and office actions are tracked and responded to on schedule until the office decides.
Fees and timing
What influences the quote
- Government fees, which differ by applicant category, individuals and startups pay less
- Whether the filing is provisional or complete
- Specification length and the technical complexity of the drafting
- Whether examination is requested early
Government fees and professional fees are shown separately in every quote. GST treatment is confirmed in the quote. Rapidfiling does not publish fixed prices for this service; request a quote to receive the fee breakdown for your case.

Important limitations
- Grant is decided by the Patent Office on examination, no filing service can promise it
- Public disclosure before filing destroys novelty almost everywhere
- Pure ideas, business methods as such, and known principles stay outside patent protection
Frequently asked questions
What is the difference between a provisional and complete specification?
A provisional describes the invention and secures the priority date; the complete specification with full claims must follow within twelve months or the application lapses. Provisionals suit inventions still being finalised, and we say plainly when a complete filing straight away is better.
How long does a patent take to grant?
The path runs publication at eighteen months, examination on request or schedule, and prosecution through office actions, a multi-year process the Office's docket dominates. We manage the calendar and report each step; we do not quote grant dates.
Who drafts the patent specification?
Qualified patent professionals with technical competence in the field, drafting quality decides the protection's scope and survival. Rapidfiling coordinates that drafting and manages the filing around it.
Can we file abroad later?
Yes, the Indian filing gives a twelve-month priority window for PCT or foreign applications. Plan the budget for those filings early; we refer you to the foreign associates when the window matters.
